What GroomBoost does

GroomBoost is an SMS-based tool that helps dog grooming businesses get more Google reviews and bring lapsed clients back. When you log a completed groom, we automatically send your client a review request via text message. We also send breed-specific rebooking reminders to clients who haven't visited in a while. By using GroomBoost, you agree to these terms.

GroomBoost is operated by Zak Kann, LLC, an Illinois limited liability company (“we,” “us,” or “our”).

Your responsibilities

As a GroomBoost user, you are responsible for the following:

• Client consent:you must obtain prior express written consent from your clients before adding them to GroomBoost. This means your clients must agree in writing (including electronic forms or signatures) to receive text messages from your business before you enter their phone number into our system. By entering a client's phone number into GroomBoost, you represent and warrant that you have obtained prior express written consent from that client to receive automated text messages from your business. You are responsible for complying with the Telephone Consumer Protection Act (TCPA) and any other applicable laws regarding text message consent.
• Consent records:you must maintain records of each client's prior express written consent for a minimum of four (4) years from the date consent was obtained. If we request copies of your consent records, you must produce them within five (5) business days.
• Accurate information: you must provide accurate client names, phone numbers, and pet information. Do not enter information for people who are not your clients.
• Account security: you are responsible for keeping your login credentials secure. Do not share your account with others.

Prohibited uses

You may not use GroomBoost to:

• Send text messages to anyone who has not consented to receive them.
• Re-add or re-enter any client who has opted out of receiving text messages.
• Solicit or post fake reviews on Google or any other platform.
• Practice review gating — meaning you cannot use GroomBoost to filter out unhappy clients and only send review requests to satisfied ones. All clients who receive a satisfaction survey must have the same opportunity to leave a review.
• Send spam, promotional messages, or any content unrelated to grooming services.
• Reverse engineer, decompile, scrape, or attempt to extract the source code of the platform, or resell access to GroomBoost or any part of the service.
• Violate any applicable law, including TCPA, CAN-SPAM, or FTC guidelines.

We reserve the right to suspend or terminate your account if you violate any of these rules.

Billing

GroomBoost is billed at the pricing displayed on our website or in your account settings. Your subscription renews automatically each month until you cancel. You can cancel at any time from your account settings or by emailing us. Cancellation takes effect at the end of your current billing period — we do not issue refunds for partial months.

SMS costs

The cost of sending text messages to your clients is included in your monthly subscription. GroomBoost pays for SMS delivery through our messaging provider. You do not pay per-message fees.

SMS program terms

The following terms apply to the GroomBoost SMS program for end users (your grooming clients) who receive text messages through the platform:

Program name: GroomBoost

Program description: GroomBoost sends automated text messages on behalf of dog grooming businesses, including satisfaction surveys after grooming visits, Google review requests, breed-specific rebooking reminders, and re-engagement messages for lapsed clients.

You can cancel the SMS service at any time. Just text “STOP” to the number you received a message from. After you send the SMS message “STOP”, we will send you a confirmation that you have been unsubscribed. After this, you will no longer receive SMS messages from that grooming business through GroomBoost. If you want to join again, you can re-consent through the groomer's consent page and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive approximately 1-4 messages per month per grooming business. Consent to receive text messages is not required as a condition of purchasing any goods or services. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Intellectual property and data ownership

GroomBoost and its original content, features, and functionality (including but not limited to software, design, text, and graphics) are owned by Zak Kann, LLC and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the platform.

You retain ownership of the client data you upload to GroomBoost. By using the service, you grant us a limited, non-exclusive license to use, process, and store your data solely for the purpose of operating and improving the service.

Disclaimer of warranties

GROOMBOOST IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT IT WILL RESULT IN ANY PARTICULAR NUMBER OF REVIEWS OR BOOKINGS.

Limitation of liability

To the maximum extent permitted by law, GroomBoost's total liability to you for any claims arising from your use of the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Indemnification

You agree to indemnify, defend, and hold harmless Zak Kann, LLC and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, fines, penalties, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of the Telephone Consumer Protection Act (TCPA) or any other federal, state, or local law governing text messages, telemarketing, or consumer communications.
• Your failure to obtain prior express written consent from any person before entering their phone number into GroomBoost.
• Any text message sent through GroomBoost on your behalf to a person who has not consented or who has revoked consent.
• Your misuse of the platform, including any violation of these terms.
• Any claim brought by a third party arising from data you uploaded or actions you performed using the service.

This indemnification obligation survives the termination of your account.

Dispute resolution

Any dispute arising out of or relating to these terms or your use of GroomBoost will be resolved through binding individual arbitration administered under the rules of the American Arbitration Association. Arbitration will take place in Illinois.

CLASS ACTION WAIVER: YOU AND GROOMBOOST AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If this arbitration or class action waiver provision is found to be unenforceable, then the dispute will be resolved in the state or federal courts located in Illinois.

Termination

Either party can terminate this agreement at any time. You can cancel your account through your settings or by emailing us. We may terminate or suspend your account if you violate these terms, fail to pay, or use the service in a way that could harm other users or our reputation. If we terminate your account, we will make reasonable efforts to notify you by email.

Force majeure

We are not liable for any delay or failure to perform our obligations under these terms if caused by events beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications outages, third-party service provider outages, carrier disruptions, power failures, or pandemics.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

Assignment

GroomBoost (Zak Kann, LLC) may assign or transfer this agreement, in whole or in part, without restriction. You may not assign or transfer your rights or obligations under these terms without our prior written consent.

Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force and effect.

Entire agreement

These terms, together with our privacy policy, constitute the entire agreement between you and Zak Kann, LLC regarding your use of GroomBoost and supersede any prior agreements or understandings.

Changes to these terms

We may update these terms from time to time. If we make significant changes, we will notify you by email at least 30 days before the changes take effect. Continued use of GroomBoost after changes take effect constitutes acceptance of the updated terms.
